1. Scope
 

These Terms and Conditions apply to all orders and services placed through the website www.scentific.ai, operated by SCENTIFIC GmbH (“we”, “us”, or “our”).
By using our website and purchasing our services or products, you agree to these Terms.
 

These Terms also apply to contracts concluded via interactive digital systems, such as chat assistants or online configurators.

3. Formation of Contract
 

(1) By submitting an order through our website, you make a binding offer to purchase the services or products specified in your order.

(2) The contract is concluded once we send you an order confirmation by email.

(3) For personalized products (such as bespoke perfumes or custom fragrance formulas), the contract becomes binding only after payment has been successfully processed and confirmed by us.
The customer acknowledges that once production begins, such items are excluded from withdrawal or cancellation.

4. Services and Prices
 

(1) We provide various services, including the creation of personalized perfumes, bespoke fragrance oils, and fragrance formulations for private and business customers.

(2) All prices listed on the website include applicable VAT unless otherwise stated. Shipping and packaging costs are displayed separately during checkout.

(3) For personalized fragrance products (“Bespoke Perfumes”), each creation is individually made according to customer specifications. Within the “Refinement Promise” program, customers may order subsequent refined versions at a reduced cost.

(4) Customers who send fragrance samples are responsible for proper and secure packaging. We accept no liability for samples lost or damaged in transit.

5. Payment Terms
 

(1) Payment must be made in advance using the payment methods available at checkout.

(2) Production begins only after full payment has been received.

6. Right of Withdrawal and Cancellation
 

(1) Consumers have the right to withdraw from the contract within 14 days without giving reasons.

(2) To exercise this right, notice must be sent in writing by email. A model withdrawal form is available on our website.

(3) For services involving the submission of fragrance samples, cancellation is only possible as long as the samples have not yet reached us.

(4) Exemptions: Goods made to customer specifications or clearly personalized are excluded from the right of withdrawal (Section 312g (2) No. 1 BGB). This includes individually created perfumes and fragrance formulations.

7. Competitions and Lotteries
 

(1) Competitions and prize draws are subject to separate participation terms.

(2) Winners are selected at random and notified by email. If a winner does not respond within 7 days, we reserve the right to select a new winner.

8. Liability
 

(1) Our liability is limited to intent and gross negligence. We are only liable for simple negligence in cases of breach of essential contractual duties.

(2) Liability for damages resulting from injury to life, body, or health remains unaffected.

9. Intellectual Property Rights
 

(1) All rights to formulas, fragrance compositions, and molecular structures created or developed by SCENTIFIC GmbH remain the sole property of SCENTIFIC GmbH.

(2) For business projects, exclusive licenses may be granted by individual agreement. Unless expressly stated otherwise, all rights remain with SCENTIFIC GmbH.

10. Use of External Partners
 

We reserve the right to cooperate with external partners for laboratory analyses, evaluation of formulations, or similar services.
In such cases, no client data is shared, and no information identifying the source of submitted samples is disclosed.

11. Data Protection

12. Applicable Law and Jurisdiction
 

(1) These Terms are governed by the laws of the Federal Republic of Germany.

(2) For consumers within the European Union, the mandatory consumer protection provisions of their country of residence also apply.

(3) The place of jurisdiction for all disputes is Berlin (Amtsgericht Charlottenburg).

 

13. Final Provisions
 

If any provision of these Terms is found invalid, the validity of the remaining provisions shall not be affected.
In the event of discrepancies between the German and English versions, the German version shall prevail.
